Terms and Conditions of the Production and Coordination of Documents

The present Terms and Conditions shall determine the procedure and timeframe for production and coordination of documents which regulate registration of second-level domain names in the top-level domains (hereinafter referred to as regulatory documents) which are administered by the Autonomous Non-for-Porfit Organization “Coordination Center for ccTLD .RU” (hereinafter referred to as the Coordination Center)

  1. General Provisions

1.1 Production of new regulatory documents or introduction of amendments into the effective regulatory documents shall be exercised upon the executive order of the Director of the Coordination Center.
1.2 Production of new regulatory documents or amendments into the effective regulatory documents shall be exercised by specially established ad-hoc groups.
1.3 Procedure for establishing ad-hoc groups is determined in section 2 hereof.
1.4 Procedure for the production and coordination of the regulatory documents is determined in section 3 hereof.

  1. Procedure of formation of ad-hoc group

2.1 Ad-hoc groups under the Coordination Center for ccTLD .RU shall be formed for production of regulatory documents for the term of production of such documents and shall terminate their activity from the date of adoption of regulatory documents by the Council of the Coordination Center.
2.2 The number and composition of an ad-hoc group shall be determined by the Director of the Coordination Center proceeding from objectives set and proposals made by the Chairman of the Registrars Committee in compliance with paragraph 2.5 hereof. Ad-hoc groups shall comprise no less than 3 (three) representatives of the accredited registrars, as well as employees of the Coordination Center and independent experts.
2.3 To form an ad- hoc group the Director of the Coordination Center shall dispatch to the Chairman of the Registrars Committee a notification of formation of an ad-hoc group with a proposal to nominate registrars in the ad-hoc group. Notification shall be dispatched to the electronic mail address of the Registrars’ Committee mailing list c-reg@cctld.ru.
2.4 Within 7 (seven) working days from the date of dispatch of the notification to the Registrars Committee envisaged in paragraph 2.2 hereof, the Chairman of the Registrars Committee shall be obligated to dispatch to the Director of the Coordination Center information of the registrars representatives nominated to the ad-hoc group.
2.5 The Director of the Coordination Center shall coordinate final composition of the ad-hoc group and its proposed Head with the Chairman of the Registrars Committee within 3 (three) working days from the date of receipt by the Director of the Coordination Center of the information indicated in paragraph 2.4 hereof.
2.6 The Director of the Coordination Center shall inform the Coordination Center Board about the formation of the ad-hoc group. Notification shall be dispatched to the electronic mail address of the Coordination Center mailing list.
2.7 Formation of the ad-hoc group shall be exercised by the executive order of the Director of the Coordination Center. 
The executive order on the formation of the ad-hoc group shall include:

    1. The name of the regulatory document to be produced;
    2. Timeframe for the production of the regulatory document including the term of its coordination in the Registrars Committee;
    3. Composition of the ad-hoc group;
    4. Head of the ad-hoc group;
    5. Budget of the ad-hoc group.

2.8 The Head of the ad-hoc group shall:

    1. Determine the procedure for the ad-hoc group functioning;
    2. Call and preside over meetings of the ad-hoc group;
    3. Control the budget of the ad-hoc group;
    4. Organize coordination of drafts of the regulatory document in the Registrars Committee;
    5. Sign minutes of disagreements on behalf of the ad-hoc group;
    6. Submit the draft of the regulatory document to the Director of the Coordination Center.

2.9 The Head of the ad-hoc group may decide to have a mailing list of the ad-hoc group in order to ensure distance work with the use of electronic mail. Creation and administration of the mailing list shall be exercised by employees of the Coordination Center. Messages dispatched at the address of the mailing list of the ad-hoc group shall be stored upon completion of the Commission’s mission.

  1. Procedure for the Production and Coordination of Regulatory Documents

3.1 The Head of the ad-hoc group shall determine and bring to the attention of all members of the ad-hoc group the procedure and the timeframe for the production of the regulatory document draft copy.
3.2 For the discussion at the Registrars Committee the head of the ad-hoc group shall dispatch to the electronic mail address of the mailing list of the Registrars Committee the following documents:

    1. Covering letter describing the issue under solution, formulation of the problem, indicating the proposed method of its solution, and timelines for the discussion in the Registrars Committee,
    2. Produced regulatory document draft version,
    3. Information note on the presence of minority opinion of the ad-hoc members not included in the produced draft version of the regulatory documents (if any).

3.3 The term of the discussion of the regulatory document draft in the Registrars Committee shall be determined by the Head of the ad-hoc group and may not be less than 5 (five) and more than 15 (fifteen) working days from the date of the dispatch of the documents in compliance with paragraph 3.2. hereof.
3.4 Members of the Registrars Committee dispatch comments and suggestions to the regulatory document draft copy to the electronic mail address of the Registrars Committee mailing list c-reg@cctld.ru in timeline determined in paragraph 3.3. hereof. Comments and suggestions dispatched after the deadline shall not be accepted for processing.
3.5 The Chairman of the Registrars Committee after the end of the term determined in paragraph 3.3. hereof, shall organize preparation of the minutes which will include comments and suggestions of the members of the Registrars Committee and shall dispatch this minutes to the Head of the ad-hoc group by electronic mail with a copy to the electronic mail address of the Registrars Committee mailing list c-reg@cctld.ru. Failure to dispatch the minutes within the indicated timeline shall represent the absence of comments and suggestions to the regulatory document draft version.
3.6 Where there are comments and suggestions from the members of the Registrars Committee, the Head of the ad-hoc group shall organize their discussion at the meeting of the ad-hoc group or by electronic mail and where necessary shall introduce changes in the regulatory document draft version.
3.7 The Head of the ad-hoc group may dispatch based on the comments and suggestions a revised version of the draft regulatory document for repeated coordination to the Registrars Committee according to procedure and within timelines determined in paragraphs 3.2.-3.5. hereof or hold a conciliation meeting with the participation of representatives of the Registrars Committee, members of the ad-hoc group, the Director of the Coordination Center (or his authorized person) and other interested parties.
3.8 For the conciliation meeting the Head of the ad-hoc group shall dispatch to the electronic mail address of the Registrars Committee mailing list, as well as to the electronic mail addresses of the invited persons (with confirmation of receipt) a notification about the date and time of the meeting, prepared draft of regulatory document and an information note containing a list of comments and proposals which implementation the ad-hoc group considers inexpedient.
3.9 Following the conciliation meeting the Head of the ad-hoc group within 2 (two) working days shall draft minutes of the meeting. The Minutes shall be signed by the Head of the ad-hoc group, authorized representative of the Registrars Committee and the Director of the Coordination Center (or by his authorized person).
3.10 The Head of the ad-hoc group may recommend the Director of the Coordination Center to conduct an independent examination (legal, economic, technical, etc.) of the draft version of the regulatory document.
3.11 Prepared version of the regulatory document as well as the minutes of the conciliatory meeting and the results of the examination (if any) shall be dispatched by the Head of the ad-hoc group to the Director of the Coordination Center. Above mentioned documents should be submitted to the consideration of the Coordination Center Board by the Director of the Coordination Center, the Head of the ad-hoc group and representative of the Registrars Committee.
